Can a convicted felon get a real estate license in Virginia? Yes, you still may obtain a real estate license if you have a prior conviction; however, the Real Estate Board has the right to deny your application if they find that "the applicant is unfit or unsuited to engage" in the real estate profession. Section 54.1-204 of the Code of Virginia states the following: "A personal shall not be refused a license in any regulated occupation or profession solely because of a prior criminal conviction, unless the criminal conviction directly relates to the occupation or profession for which the license is sought. However, the Real Estate Board shall have the authority to refuse a license based upon all the information available, including the applicant's record of prior convictions, it finds that the applicant is unfit or unsuited to engage in the real estate profession." You must disclose any prior criminal activity on your Virginia Salesperson License Application. This means you cannot have the Real Estate Board review your case until you have completed the pre-license education requirements, passed the state exam, and submitted your fingerprints. You must disclose any prior criminal activity in section 15 of the Virginia Salesperson License Application. If you have any prior convictions, you must include the following information in section 15c: • The state/jurisdiction where the conviction occurred. • A description of the conviction. • The type of conviction (felony or misdemeanor). • The date of the conviction. • The disposition (probation, parole, fine, sentence, etc.). • The status of the conviction (incarcerated, on probation, or on parole) According to section 15 of the Virginia Salesperson License Application, a conviction includes the following: • Any local, state or federal misdemeanor and felony convictions (including moving traffic violations), and all military and foreign convictions. • A guilty verdict by judge or jury, a plea of guilty, or a plea of nolo contendere (or "no contest"). • Convictions as a minor (under 18 years of age) if tried as an adult are also considered convictions.See the answer for every state

A sponsoring broker is a licensed real estate broker who supervises a salesperson and holds responsibility for that agent's real estate activities. In Virginia, a salesperson license cannot become active until a licensed broker agrees to supervise the agent and submits approval to the Department of Professional and Occupational Regulation (DPOR). Without a sponsoring broker, a salesperson holds an inactive license and cannot practice real estate. Can you get a real estate license in Virginia if you dont live in the state? Yes, you are not required to be a Virginia resident in order to obtain your Virginia real estate license. Where to get fingerprinted for real estate license in Virginia? You will be electronically fingerprinted at the PSI testing center after you pass the Virginia state licensing exam. Even if you live outside of Virginia, you are still highly encouraged to get your fingerprints taken at a Virginia PSI testing location, as this will speed up the mandatory background check process. If you cannot get your fingerprints taken as a Virginia PSI testing location, please contact the Real Estate Board. The Real Estate Board requires all applicants to submit a set of fingerprints to the Virginia Central Criminal Records Exchange for the purpose of conducting a state and national fingerprint-based criminal history check. The Board will use your criminal history check to verify that you have fully disclosed any past criminal activity on your Salesperson License Application. If there are any discrepancies between your criminal history check and your license application, the Board may deny your application. Your fingerprints cannot be older than 45 days from the day the Real Estate Board receives your criminal history record to the day the Board receives your license application. For this reason, we recommend waiting to get your fingerprints taken until right after you fully pass the Virginia state licensing exam.
